Club Blue and The Warehouse, run by BOAZ International, LLC., and owned by Chris Smith and Bob Cochran, were charged with being disorderly places and improper acts. Fan Club was charged with improper acts.
The charge of being a disorderly place was brought against Club Blue, which has a "retail liquor by the drink-resort" license. The Warehouse, has a "retail liquor by the drink" license.
According to the MDATC, an establishment is deemed a disorderly place by the amount of minors in posession of alcohol reported. Improper acts, on the other hand, include employees failing to follow alcohol laws, being uncooperative with law enforcement officials and repeated fights and disturbances.
The revocations marked the first time such orders were issued from the state level, following regular annual reports of alcohol-related regulations violations at the three establishments sent by the Warrensburg Police Department to the MDTAC. The revocations were for 2006 violations.
The revocations went into effect at the beginning of the month; Feb. 1 for Club Blue and The Warehouse and Feb. 8 for Fan Club.
Joe Hodgin, district supervisor for MDTAC, previously told Digitalburg.com that Fan Club had a "huge amount" of reported minors being caught in possession at the establishment and added that the reported MIPs for all three establishments were all "within 10 percent of each other."
"An action like this communicates that there are laws in effect, and if they are broken, there are severe consequences," City Manager Jeff Hancock told the Muleskinner in January.
In a recent interview, Hodgin said although Club Blue and The Warehouse received extensions on their revocations, they never sought to appeal them.
"They got the revocations extended because their lawyer couldn't be present at the time, but they still did not appeal the revocations," Hodgin said. "As far as Fan Club is concerned, they appealed, but it was denied and they have to close."
Furthermore, although Hodgin would not state a specific date, a hearing will be conducted by the MDTAC concerning the status of Smitty's license, also because of alcohol infractions, in the coming weeks.
"Warrensburg Police Chief Bruce Howey told the Muleskinner in January "there is a certain expectation of obedience and compliance, and when that doesn't occur, there are severe consequences. It is no different than following traffic laws to keep one's driver's license."

These three clubs have had hundreds of minor in possession (MIP) violations over the past few years. The city already had laws and regulations on the books to deal with these establishments that had excessive MIP violations. (Continued…)
